Judge throws out teens statement in arson and murder case

The judge in the case against  Michael Pilato, the Webster teen accused of setting his family’s  home on fire last December,  has thrown out all statements the then 15-year-old  made to police.

The judge ruled that police did not notify Pilato’s mother about his arrest. She was not given the option to be present  for his questioning or invoke his right to a lawyer. Although hospitalized,  she was conscious and able to talk to the police.

Pilato’s father and two brothers died in the fire. His sister and mother were hospitalized.  The trial is scheduled for January.
